Tran v. Aujla

The parties disputed ownership of a home registered in the defendant/builder’s name.

The trial court originally held that the plaintiff was entitled to a half interest in the home, regardless of the amount of money and labour contributed by the defendant in building the home. Mr. Barron was successful in the Court of Appeal in obtaining an order that the defendant/builder was entitled firstly to his entire costs of building the home, and only after that were the remaining proceeds of sale of the home divided between the parties.
