In this litigation the plaintiff sought to enforce a contract to purchase the defendant’s home.
Upon commencing litigation the plaintiff registered a Certificate of Pending Litigation against the property, thereby preventing its sale while the CPL remained on title to the property. Two years later the plaintiff had taken no further steps to pursue its lawsuit, but steadfastly refused to remove the CPL. Mr. Barron was successful in obtaining an order removing the CPL. (The plaintiff applied to appeal that decision to the Court of Appeal, and leave was granted to argue the appeal, but the parties settled the matter before the hearing occurred.)
